Women who have abortion in Nepal are still stigmatised

Every day Shanti Shresta thanks God that she is free. "I thought I was going to rot in jail," she says. "I never thought that I would be released."

Four years ago Shanti was arrested and thrown into prison after the authorities accused her of having an abortion.

At the time this was a crime punishable in this Hindu kingdom with a life prison sentence.

Her ordeal began four months into her fourth pregnancy.

One fateful afternoon, feeling sick and dizzy, she swallowed some paracetamol tablets to cure a nagging migraine.

"I knew instinctively that I was miscarrying, and I had lost my baby," she recalls. "My underclothes were drenched in blood."

With her children at school and her husband at work, Shanti turned to the landlady of her rented house in Kathmandu for help.

The woman took her to hospital but reported the death of the baby to the police, something that she was legally obliged to do as the owner of the property.

Many women were sent to prison and some may remain there

Because Shanti's pregnancy was so far advanced, the authorities suspected she had had an abortion.

She was arrested while recovering in hospital and four armed police stood guard by her bed. "I was so sick there was no reason for them to guard me, I could not run anywhere," she said.

Her husband took care of the couple's two teenage daughters.

But Shanti requested that her five-year-old son stay with her so that her husband did not have to give up work as a taxi driver.

After hospital, she was transferred to a jail in the Dillibazaar district of the capital, Kathmandu, trial. Her son went with her.

The overcrowded conditions in this small prison on the outskirts of Kathmandu, which is meant to house 32 women but crams more than 60 into one open-plan concrete cell, was too much for Shanti.

Her request for a transfer to Kathmandu Central Jail was granted, and six months later she stood trial accused of having an abortion.

By this time the psychological stress had taken its toll. She would find herself crying for no reason and suffering from hypertension.

Efforts are now being taken to rehabilitate the women

Her husband had paid a lawyer around $20 (1500 Nepalese Rupees) to defend her, but unable to read or write she found it difficult to understand the proceedings.

"I didn't know what was going on, I was very confused. They said I had an abortion. The police made me sign a piece of paper. I did not know it was a confession."

Shanti was sentenced to 20 years in jail. It was then that both she and her husband made the decision to place their youngest child in a hostel, as she was finding it difficult to cope looking after her son in jail.

She would often have to forsake meals in order to feed her child because in prison female prisoners have to share their rations - a cup of rice a day - with any accompanied children.

Like most prisoners, Shanti depended on donations from her family, her husband would bring toiletries and sometimes money once a week.

"I was on one side and my family was on the other, it was very hard," she said.

Nepal legalised abortion in September 2002 after pressure from human rights organisations and the country's Family Planning Association.

The women that tended to be in prison on abortion charges are generally illiterate, poor and from rural communities

Under current law, women can have an abortion within 12 weeks of pregnancy, 18 weeks if a woman is pregnant because of rape or incest, or at any time if it is believed that the pregnancy will affect her health and that of her unborn child.

Pinky Shah, Programme Officer from the Rural Women's Development and Unity Centre (RUWDUC) says that the assumption was that as soon as the law had been passed, women like Shanti Shresta would be set free.

She estimates there were nearly 60 women in situations like Shanti Shresta's and that almost half of them are still in jail.

Now King Gyanendra has announced an amnesty for 12 women in jail for having abortions.

"We intended to rehabilitate these women back into the community. We had money set aside for a shelter, counselling provision and vocational training for those women."

Shanti Shresta ended up spending four months in a hostel in Kathmandu, where she received counselling, as well as acquiring skills such as literacy, accounting and tailoring in order to set up her own business.

Because of the social stigma associated with being jailed for abortion, her family had to move out of the neighbourhood she lived in Kathmandu.

In the past two months, she has returned to her husband and now runs a small shop near the city selling homemade cakes and savouries.

But she is still deeply traumatised - so much so that she has not yet been able to find the hostel where her son is.

"This incident took away precious time with my son. I would give anything to see him again and to make sure that he is okay," she says

His Majesty King Gyanendra has -- upon recommendation from the council of ministers-- pardoned 12 women prisoners convicted of abortion, on the eve of the 15th Constitution Day on Sunday According to the department of prison management, a total of 15 women are serving life sentence in various jails in Nepal on charge of carrying out abortion. Abortion on medical grounds, among others, has been legalised in Nepal since 2002. The government would withdraw cases against the remaining three women too, reports said.

The fact that women are stigmatized in Nepal is not surprising. That happens in America too. The President himself is against it. Now with the mandate that he has got, he will appoint neo-con supreme court judges to replace the dying ones and there goes Roe Vs. Wade.

Where is out Roe Vs. Wade? On what legal basis did King Gyanendra pardon the people who were taken into custody? just because it was his birthday? no legal reasoning, no change of future assult and no concern about the real issue. well its my birthday, i am feeling generous. so if someday lets say He is in a bad mood, will he execute the prisoners ? our nation runs on the whim of our leaders...the lack of set laws, the lack even of trying to set up laws concerning this and other "uncomfortable" issues need not wait for somebody's birthday!

Mind Games
Whatever occaison it is, aren't you at least glad that they are out ? In an abortion there are two guilty parties. I mean to be fair they should jail the sperm contributer too. I agree that they should not have to wait for anything. But I am just glad they are out. For crying out loud.. the lady took migrane meds and had a miscarriage. Accidents happen, and this lady should not be in jail for something that was not intentional(esp since the law has already been passed).
Every country is ruled by the whim of their leaders eg Taliban, King Fahd, Kim il Sung, George Bush....etc etc Remember when Clinton pardoned that Tax Evader from 60's or 70's.

i always thought that argument against abortion was of a catholic stance, so it shits me when nepal follows that white moralistic line. to think that women are in jail because of an abortion, whatever reason it may be for, is wrong in so many ways. we hardly have enough legal and moral jurisdiction for adults, the freaking govt wants to imprison woman because they are guilty of murdering an unborn child.
the govt can't look after u but if u harm that foetus, we will make sure we look after u.
all i can do is emphatise,and my heart goes out to these ladies, i am so sorry 4 this travesty. and i pray for u didi bahinis.

BathroomCoffee,no i am glad the poor souls were fortunate enough to be free despite the self serving occasion. but i would have been happier if he worked to formulate laws that are more progressive and avoid such mindless convictions in the future. that would have been a better gift of birthday genrosity.

abortion is murder except in some exceptional cases cases like danger to the mother,rape etc....
if you dont want a kid then dont f... around and if you f... around use a condom or smth and if you dont do so then a kid has a right to get born...... two peep f...around and have fun and a kid has to die for that o heck no...............

seriously if thats right then the taliban way of women treatment is also right ,if you understand what i mean.... not always the thing is about women right,if women have right then so have the unborn child..... pretty hardcore on that mate..

it is not only catholic thing,it is bad and it should be punished as murder according to the law of the given country. and that goes for both woman and man if the man lures or forces the woman to commit a crime like abortion.

and yeah alwasy get a way to blame the king,ghumyo firyo rumjatar, why the president of india does that,the queen of england does that i guess and lot of head of the state do taht,and do you think the king can do that jsut like that so easily man jsut becuase it is his b day... stop blaming the king all the time for every single thing..

Mahakaal Bro... ! What to do in places where people don't know the existence of condom? Forget about using! Isn't aborting a foetus that has not had life yet better than giving it life and not being able to provide it a good life? Or is is okay to produce as many children and leave them in gods hands? Mind you, technically until 8 weeks a foetus does not have life. So, instead of giving life to a world of depravity aborting is a sensible option. And it's aborting before life... not murdering. There's a difference bro. Well... just my perspective.

i believe it's the woman's right, her right to do what she wants to, ie have the baby, abort,have a ceasarian, whatever.........her right. and as my post begins with a i believe, thats exactly what it is, an opinion. and opinions are like ars.eholes, everyone has one. so dont get ure panties in a twist, allright.
i merely said what i believed.i believe its her right.
how would u feel if u were trying to pass a watemelon thru ure ar.se and some govt official sat by ure side and said, haina tyesari hoina, rule 123 says u have to have ure arms linked.fork off.
the woman has the right. thats it, according to my belief.
fork all the shit about morals and blah blah, like blank said, it depends on the situation. no woman would have an abortion without going through all the necessary guilt and remorse. sh.it, she's been carrying it for a while.far out i've had stronger bonds with pimples on my forehead that have been there a week. so the last thing she needs is to have to face a prison term after all that angst and suffering. and some asinine moralist that tells her she has to go to jail, directly to jail , without passing go. FORK U



btw.........i believe the king still sux, just an opinion.

yeah i know there aint condom in lotta places that true but oh well you know when you f.... you ll have a baby well most of the time.and if you know how to kill that child before it comes out then you should also know when and how to f... to not have a child.it ofcourse is not goood to leave a kid in gods hand but what would you say if somebody kicks a pregnant woman in her stomach,say not so hardly in front of evrybody,now how will you charge that offender ....... jsut a simple assault or smth else....you know what i mean

i beleive in woman right tooo but not always everything is woman right.

dont f.. around if you dont want the kid.... simple or use smth as i said.and if you are smart enough to know about abortion then you are smart enough to know about preventing pregnancy too ......

Tell the man in BAJURA to use a condom! Just because her husband f***** her? tell her to carry the melon, like Kdee said, for nine months and pass it through her **** and bring one more kid to the poverty stricken district.

Nepal being one of the countries with highest maternal mortality rate? and with too many sex and reproductory health related problems, its not right to give abortion an immoral color. Abortion being legalized will reduce suffering of many rural women and men. Isn't to choose "not to suffer" and "not to bring any to suffering" a human being's right?

Just for information: The embroyo does not have life until 8 weeks and is called foetus after that. At 8 weeks the weight is 3g and size 3 cm (1.18 inch)

poor people are evry where in the world and may be poor people are more if you classify in the whole world.and you should know how many people are below poverty line in nepal.so becasue you are pooor you kill a unborn baby... if thats so then there are a heck lot of thing you can do.... ..why marry at alll and also if that is the case then no person under the poverty line should be allowed to have a child even one cause i dont think them can even properly feed one kid......
yeah abportion lai legalize garyo bhaney chai remote area ko manchey lai rarmo hune..... eee hai, family planning chai tha napauney legal abortion chai tha pauney ..yesto ni huney ra...... poverty le manchey lai ke ke garnu badhya tulayuncha i knwo and i can understand but .......... dont want to suffer then dont fu...
and i ll repeat in the legal side, if i kick a pregnant woman in the stomach then charge and punish me for just kicking/assault/fighting smth...... if do kick then i know i ll be charged for smth else like killing a baby or smth..... let that kicking be taken as a simple offense as a simple kicking then i ll say the abortion law will be unbaised.the example i stated may sound stupid but makes a point as welll.its just "one" perspective.

bottom line abortion is wrong except some cases and should be dealt harshly...

i didnt even know abortions were illegal in nepal.. ive heard of so many ppl having abortions.. or is this another rich/poor thingy,where the rich pppl get away with anything and everything and the poor ppl get all the laws enforced on them... dyamm...
class race religion.. ppl r too caught up in all this..

Listen mate? no need to lose your cool. My point is nobody aborts just for the heck of it. They do it because they have serious reasons behind it. But pregnancy can happen with or without any reasons.

You are right poor people are everywhere. Furthermore, they are ALSO the ones who suffer most. According Human Dev. Report 2001 almost 38% of Nepalese are below poverty line. And mind you? it is not "killing the unborn baby" because you are poor but "aborting before 8 weeks" because you have a choice. Many women have lost their lives trying to abort by using local poisonous herbs. Yes, mahakaal there are local ways of aborting? where condoms have not reached. And as the news in the beginning of this thread, many have landed in jail. I think legalizing abortion safeguards these women and encourage them to access proper health services. Aborting in cities and by the rich has not been a problem? but rather the uneducated and the deprived ones suffer the most.

I don?t like your example of kicking a pregnant woman. Its too graphic and you can't go around go kicking any woman because you don?t have the right and because you will be thrown in jail your balls sliced off by police.

Or did you mean kicking your wife or somebody you know? Just do it and you will get the answer! I will even consult my lawyer give you the answer!
