I think in some states it is not illegal, but if you want to use the taping as your defense to prove something you have to let the other party know that you are taping the conversation. I guess it all depends on the situation. Again, he mentioned that he taped for himself not to use against them...

First of all sorry that your friend went through all these hassels.
There's a reason why car salesman are notorious. Car buying, specially used cars, is a hassel. You negotiate with the agent and finally agree on a price then he says he has to check it with his manager! What? I thought that was the final negotiation. The manager then comes back and says the agent has no idea what he is doing and there's no way he can offer the car for amount that low. 1.5 hours wasted testing/negotiating and they know that it's an incentive for them to close the deal as you don't want the process to start over again.
Then there are times when they list a car for certain price and when you get to the dealership (after making the call to confirm the car exists), they say the car just got sold; but they do have other comparable offers price of which are way higher.
Anyway, I am glad that your friend is not giving up. I don't know about BBB, but small claims court might be a good idea.
Lemon law will not apply as this car is not lemon, it's just not pre-certified.
