This is the most harse regression of king G's government. Even the royalists will have to soon eat 'gobbar ko laddu'. Some most chamcha royalists may get the benefits if he or she become the Mandale of Kamal Thapa. This is new amandament in the regulations.

Bar on studying abroad sans govt nod

Kathmandu, February 15:

The government has introduced a new legal provision that bars students from going abroad for higher education without getting permission from the Ministry of Education.
Issuing an Ordinance to amend some Acts regarding the education sector, the government has prohibited people from going abroad for higher education unless they get a no-objection-letter from the Ministry.
“No Nepali citizen can go abroad for higher education unless the Ministry of Education and Sports issues permission,” the Ordinance states. The government issued the Ordinance amending the Scholarship Act 1964, the Education Act 1970, the Technical Education and Vocational Training Centre Act 1988, the Sports Development Act 1991 and the Nepal Scout Act 1993 with some amendments in the areas. The Ordinance also gives chances for temporary teachers to be permanent.
“The Ministry will issue no objection letter if it sees grounds to provide it only after a thorough investigation,” states the amended provision of the Scholarship Act. The King put royal seal to the Ordinance on January 30 and it was made public on Monday.
“Without the ‘no objection letter’, the government will not provide exchange facilities of foreign currency for the persons who want to go abroad for higher education,” states the Clause 4(3) of the Act. The Ministry will recommend the authorities concerned to provide the facility only after anyone receives ‘no objection letter’.
However, the provision would not be applied for the civil servants and the Civil Service Act 1992 would govern the civil servants in this regard.
Another provision in the Ordinance states that if a person does not return to the country or does not contact the Ministry upon the completion of his or her foreign degree with scholarship, he or she may face fine equal to the amount he spent during the study or the amount received as donation for the study.
The spokesperson for the Ministry of Education and Sports, Lava Prasad Tripathi, told THT that the new provision was issued to avoid the flight of students in a disorganised manner. He said most of the embassies will require ‘no objection letter’ before issuing visa to the students.
He added that the provision was made in order to fulfil legal loopholes in this regard. “Since when it was essential to get visa while going abroad for education, we have made this legal provision to make the foreign education further systematic,” Tripathi added.
General Secretary of the Nepal Teachers’ Organisation Baburam Adhikary, chairman of PABSON Umesh Shrestha and general secretary of the N-PABSON Karna Bahadur Shahi have accused the government of imposing regressive legal provisions in education sector.

This law or process has always been there. When I came to US I had to get the "letter" from the Ministry of Education before RB issued me the dollars..

yeah, the rule is nothing new, its been on the books forever

however, im guessing that the significance is that it wont be quite as easy to get this letter from now on.

This govt. talking about "systematic process" is an oxymoron.

No, I didn't need that " letter" for foreign exchange for my coming to U.S. a decade ago.

Just another way to extort money from desperate students to get that "letter".

First of the title of the thread misrepresents what the policy is being created for.
Not that long ago when a student was killed in a gas station, people raised the question of how Nepalese need to make sure they can pay for what they come here for. I think its high time government put restrictions on who and how one gets a visa. I know several people who show someone else's property/money as their own and "trick" the colleges abroad for an I-20/acceptance documents. I think that should be discouraged and may be this policy will do that.
I also know of several people who have had criminal background in Nepal and leave the country as a student to escape the punishment. Getting a "no objection letter" should curb those incidents too. Another issue, it will take under consideration will be black marketting of the dollar. The way foreign currency is leaving Nepal is very scary.
As far as I can understand, this policy of "No objection letter" has been there. I remember getting a letter before I got to go abroad. So don't make it a big deal. Its good for you. Only make it a big deal if you have something to hide and you are not sure if you can get a legitimate "no objection letter" from the ministry of education.

Making rules is one thing - Enforcing totally another. Another proof that Gyane is a motherfuker... What's next ? You will be required to get no objection letter to post in Sajha... but who is going to enforce that... haha.. Obviously motherfuker needs some education...

I am not surprised. I knew that this was coming. During the times of Panchayat, the Government also barred people from studying abroad with bureaucracy. I know an uncle who wanted to go study in an Eastern European country about 17-18 years ago. But the Panchayat Government would not give him permission and foreign exchange to study computer science abroad. So he had to lie that he is going to study in India. He went to India first and then only he could proceed to the Eastern European country.

Since he went through the back door, he could not get foreign exchange from the Government to pay for his school. So he used to go to Hong Kong or Bangkok, buy electronics, and sell them in the Eastern European country to pay for his school. There are many stories like these.

So I feel lucky that I did not have to go through the same process to come to the US since the democratic governments really eased the process for people to study abroad. And a lot of young people do not realize what our older generation had to go through and how fortunate we were under the Democratic Government in spite of the corruptions and abuses.

One of the tools the autocratic government uses to control public discontent is by making sure that people do not get too smart and conscious. I think Government has taken a series of steps to accomplish this.

1) Nationalistic Uniform Education Policy: During Panchayat, Government used the education policy to brainwash school kids that Nepalese are peaceful and simple people who love their King. One of the first steps the new Government took was to change the curriculum for school kids and started putting pictures of the Royal family.

2) News on FM radio: FM radios are independent and have wide access to people because they are affordable and you do not need to be educated to get news from FM. This is why the Government has not scrutinized TV and newspaper as much as FM. The autocratic Government wants to limit news to the masses, which I think as one of the great accomplishment under the democratic governments.

4) Restricting NGO: KG's Government does not want NGO's making masses educated about social justice and so on. So they brought this new law to control the NGO's

3) Limiting people going abroad for studies: This is another tool the government is using to control young people.

So you royalists in Sajha who are studying in the US, KG is tightening its grip even around your neck. While the conniving KG tries to trick the world with the election drama and talks of democracy, he is making subtle moves under the radar screen to tighten his control with an iron fist. KG is here for a long haul. So all of you there, be careful of this monster and do not get swayed by his sweet talks.

I don't understand this. I thought the clause was already there. When I first came to US as an F1 student, I went to the Ministry of Education for the letter of "No Objection" and they gave me one. I don't understand why this should be a headache to anyone. If someone deserves to go overseas for further education, I dont think the Ministry will object as long as it is legitimate. May be the rule was not official before and now they have made it so. Chill out guys, I dont think you have to worry too much unless you deserve to be here.

I did not read the post from VincentBodega. He has spoken my words already. Why so fuss about this? Rules made for improvement should be appreciated. I welcome this step by the government.

I think this thread got wrong name. This is not actually BAR. I guess it's a good move to organize the way students are going abroad and has mainly targeted those who come to study abroad in government scholarship quota and send their resignation letter from abroad in stead of going back to Nepal.
The students who can show that they are going to abroad for good reasons should not be worried with this change in rule.
Fellas, please have a look at both side of the coins before posting.

But Hunk in Grave, can you describe what kind of improvement will you see from this? Improvement of what and why would you call that an improvement if that is an improvement?
This new law , even if enforced, will not benefit anyone (except for a few people). Certainly not the country. The brain drain Nepal is suffering is not due to lack of this kind of silly laws but due to the failure of whole system. This law is not going to fix the problem at all. Fix the education system to begin with. Those who have studied with a government scholarship do have obligation to fulfill their part of the contract and they should be dealt with if they failed to do so. But this sweeping law for all is ridiculous. But then those lawmakers and other officials do need to appear like they are working, doing something for the country and therefore, they put forth this type of laws from time to time even though no intention to enforce them.

I donot think this is A BAR on the students inclined to go to study abroad. It is just a trick of the poor government to collect some money from us, coz the economy is so fk'ed up, so, let them have couple of dollars........

साथी हो मैले लेखेको कुरले मलाई राजाबादी न भनु है तर यो systematic गर्ने कुरा नराम्रो चाही होईन । actually यो नियम को लक्ष्य नेपाली हरुलाई बिदेश म पढ्न नदिन होईन तर तेस्लाई बेवस्थित गर्न हो । एउटा उदाहरण दिउ -- सरकार ले लाखौ लगनी गरेर एउटा डाक्टर निकाल्छ र अहिले को trendd अनुसार आधा जस्तो पढाई सक्ने बित्तिकै अमेरिका आउन कम्मर कस्छन जबकी देश मा गाउँ गाउँ म डाक्टर को अभाब छ । उनिहरु नेपाल बस्न नसक्नु म system लाई दोश दिन्छन तर के तेही नराम्रो सिस्टम भित्र को एउटा सानो राम्रो पक्ष्य ले तीनइहरु डाक्टर भएक होईनन ? ? ? सर्कार ले धेरै पहिला नै गर्नु पर्ने काम गर्दै छ अब , सरकारी लगनी मा पढेक मन्छे लाई केही निस्चित समय सर्कार ले तोकेको ठाउँ म काम नगरि बिदेश जाने अनुमती नदिने , या त उनिहरुलाई पढौदा लगेको खर्छ फिर्त गर्ने ।
जो मान्छे आफ्नो खर्छ म बहिरा पढ्न जान्छ त्यो पक्कै पनि यो नियम ले बन्चित हुँदैन र हुनु पनि हुँदैन ।
finally यो नियम यो असंबैधानिक , अस्थिर्, अप्रजातान्तृक सर्कार ले लगए पनि यदी राम्ररी पलना गर्‍यो भने नराम्रो चही होईन ।
