I had H1 since October 2008. No job yet. Consultancy told me to leave and handed me 2 pay stub. What should I do now? Can I join Kaplan? Man, My brain just froze on me. Somebody give some suggestions. Thanks

Try to transfer to another consultancy. OR go to F1. I guess you can re-instantiate your H1 in future again.

Kaplan is good idea. You have to "spend" 20 hrs / week in Kaplan.

 I had one friend through the same situation... But he did it through lawyer.

General steps is - Get admission to Kaplan, and they will issue you I-20. Next, you will need to apply for F1 at USCIS with that I-20.

If you get a lawyer, he will take care of everything.. You should get all done (admission, F1, lawyer fee) at around $1K max.

The problem is they are saying bye bye to me on may 31st, which is right around the corner. I have found a university that will issue i20. The only problem is I might actually get I20 by June, which might put me in a compromising situation if the consultancy revoked my H1. Any idea?

Just 2 pay stubs ! I think, recently there was news that consultancies were made to pay all the salary since beginning to the employee. They also needs to pay you air fare to your home country.
I suggest contact lawyer and see if you can establish F1 status for now, and file a complain to DOL about you being unpaid since 2008. You may get unpaid salary and compensation since 2008 weather you were on project or not. I suspect, because of this thing they are revoking your H1.
Take help of lawyer. Look at DOL site for more. Check murthy forum and study similar cases.

Yes, work on getting on F - 1 ASAP and then once you have the status confirmed. Milk the Indian dog for all the wages from the day H1 started to the day he handed you the termination letter. DOL will make the bastard pay for all the wages till the termination date.

Khairey: Yeah, right now I don't have an upper hand. So, I am concentrating on getting I20 and applying for change of status by May 31st. Hopefully. If they revoke H1 on June 1, can I still apply for change of status?
