I am getting problem w/ getting Individual Tax Payers Identification Number for my spouse (she is on F2). W-7 instruction says W7 application should be submitted along with the applicant's tax return. I went to IRS service center and the lady over there made me more confused by saying that when I fie my tax (I am filing 1040 NR) I need to attach her W-7 application with my Tax Returns n order o get ITIN. The process the lady said and written on publication are different. Does anybody have any idea on process? Please advise.

I am not willing to send her orginial documents to Philadelphia IRS for document verification ( a process for W-7) by post.

My cousin did exactly the same, Sent in W-7 alons with his tax return, but haven't gotten the ITIN # yet.....IRS is screwed up !!! They are way slower than even our Government in Nepal !

go to nearest indian lawer who does tax file as well they will take care everthing. in 2003 i filed myself and got about $700 altogether (federal+state). last year i went to this indian lawer and i got $3300 and took care of TIN as well.
need more info?? let me know.

S.Man Ji,
Can you please explain this thing clearly we have an US citizen baby also. How should we file for maximum return. They say spouse is not an dependent and the student should file as a single. Also, since we are on F1 and F2 there will be no difference where the baby is born

I had the same problem. I went to HR Block thinking that they would solve this problem. They filled out my 1040 form and gave me the completed copies to mail. Usually they should be able to file electronically. But since my spouse didn't have ITN, the system won't let you do that. One thing I knew that write down APPLIED in the box, where it ask for Spouse TAX ID. Now fill out W-7 form. I notarized the copies of her passport from Town Hall... I thought that would work since it's mentioned in instruction. Then, I send everything to Philly IRS office...

I don't know if I am screwed up or not. Some of my friends suggested me that it should work without any delay. It takes about 4 to 5 weeks. I hope I won't have to hire any "Indian" lawyer for this.

One thing that you should be very very careful about filling W-7 form. Don't make any mistake. Follow the instruction.

Fill this form and send. It does not take long. I did the same and got TIN.

don't listen to them, listen to lawer. lawer(indian/south asian prefereed cuz they understand our situation then any other does) makes everything possible (like getting greencard even if you are illigel).
try to avoid tax filing seminar conducted by your college/university (because they tells you straight way and we miss our right/benifits).
if you are student and married (having child (no matter US/Nepali citizen) is plus, no matter where your family is Nepal/US) then you are in low income category and you have right to get all your tax back (even more sometime). your spouse is eligible for Tax Identification Number (TIN) also equivalently called SSN. lawer will do this for you.
Lawer will return all your old tax money as well (it will be easier if you have copies of previous tax forms).
save all the airplane tickets, travel tickets, and fee paid to college/university, previous appartment/house contract letter (including electric/heat/phone etc) or any other expense, it will help your refund amont.
if you filed wrong form they will hesitate to process so don't do mistake.
these lawer has to sign, has to print name of law office info, has to give their SSN
and charge would be about $50 to $70.
so visit your nearest lawer and have fun.

Well, that's a good discussion going over here. Euta Nepaliji, as far as i know you have to attach your wife's W-7 form with your tax return. Please verify with experts if any in Sajha expert panels. Do not send original docmunets to phily . Get it notarized if possible. I dont know abot how to get notorization too. Suggestion from experts arre again welcomed.

I spent a lot of time doing research on this and i just applied for ITIN and they said that it takes about 6-8 weeks.
Do your tax return under married filing jointly, which means you do not have any dependent since you are already filing it jointly, unless you have a child. When you file the tax just write APPLIED where it asks for the spouse's social security. Then fill out W-7 form completely. Make a copy of your passport(don't need visa) and notarize it(your bank people can help you on it) and mail the whole package to philadelphia. They will assign you ITIN and then send it to the concerned IRS for your return and you will get the check in the mail.
If you are student then you will probably have to fill out the education documnet to get the credit for your tution.

Or fill out the W7 form yourself and get the passport copy notarized and go to H&R block and they will do the rest for you

Dariwalji, I am on F1 status. I had paid partial tution fee during my graduate study. Before when I filed Tax, the uni used to help and they never include tution in return. So I do not have idea on it. Could you please describe in more detail...........that would be of great help.

You can claim the tuition as deduction on your tax return. I don't understand when you say "partial" and assuming that you receive some kind of grant or scholorship for the rest. You can still claim the tution on your deduction hence get more back on your return.
If you didnot claim that on your last year return, you can still correct it. I don't know how to go about correcting it but i know that you can

Euta Nepali,

From my past experience, an F-2 visa holder from Nepal does not need any tax identification number. If you are an F-1 visa holder,then you are filing the tax as a single regardless your marital status.

Dariwalji, Partial means on Graduate Research assitantship on which I had to pay 35% of tution fee. By the way I couldnt find the column in tax form to enter the 'Tution'. Is it in miscellanous or some specific section?

What form are you using? Are you filing it electronically from turbotax or etc OR you are filing it via mail?

Filing by mail. I used to file 1040 NR EZ. This year I am filing 1040NR.
