Namaskar!

After teaching in a remotte part of Nepal for 20 years, I decidedd to apply for Canadian visa. We used Everest Immigration & Legal Service for our process. Everest Immigration has branch in Kathmandu and main office in Canada. The lawyer + owner is Mr. Milan Karki. It has been more than year since we applied for the visa.

Recently we came to know that Mr. Karki (who is representing our case in Canada) was arrested for domestic violence and physicall abuse (related to his wife). He is out in bail and his hearing is scheduled for sometime is June. According to a friend in Canada, Mr. Karki's certificate will be suspended. He had similar situations earlier.

We spend lots of money for this visa. We can are concenred to our visa application. Please help me in following question.

1) Can a lawyer loose his certification if he is found guilty in domestic violeance? Looks like this is not the first time. He faced similar case eariler. At the moment his is restricted going to his house and wife is living in a goverment managed facility.

2) If he looses certification, what will happen to my case? Who will represent? I believe he is the only lawyer in Everest Immigration.

3) Is it a good idea to use other law firms before mr. Karki’s case is decided?

4) We paid all the fees at the begining. If we change the lawer, can we get money back from Mr. Karki? Is there any law or regulations that protect customer like me? Or Any NGOs to help us?

Earlier me and my friend (who also applied for Canada from Everest Immigration), went to Everest Immigration's location office in Lazimat, Katmandu. We just wanted to know if Mr. Karki was arrest and what will happen if he is found guilty. The lady (receptionist) was very rude. We were told to leave the building immediatley. We went again (after two days) to talk to upper level people. We were behaved badly. We were told to leave. Otherwise they were going telephone police. Also, we tried to telephone in Canada Everest Immigration Office and we sent e-mails. It has been two months, we have not received anything.

 I spent lots money for Canada visa. I am really worried. Any suggestion will help this "Dukhi family" a lot.

This guy does not have moral and ethics. I had seen him closely, when he was “so called” a student leader, human right activist and a writer. All he cared was for money. He always changed his faces for money. He could do anything for money.

I am not surprised by his unpredictable behaviour, physical assault and arrest. He definitely needs mental therapy!

I do not know what type of immigration you applied for, If you have applied for skilled worker class and the application is already submitted to the Canadian embassy in Delhi. No need to worry, your application is automatically processed. Application of all  Neplese who applied from Nepal is processed by canadian embassy in Delhi at in general it usually takes 72 months. If you have applied under a list of professionals like hair designer, cook/chef etc it usually takes 2 years., But Canadian govt changes this list from time to time depending upon thir demnad in canada.

In any general immigration there is no use of lawyer. They cant play a part in selection process, they cant make your selection faster. They can do nothing,
Yes, if you have applied under human right abuses, maoist abuse, and refuges etc then lawyer can play a part to prove your case. In skilled worker class lawyer cant play any role. They just fill your form according to the rule and apply that is it.
You dont need lawyer to fill the form and apply. You can do it yourself. all forms and materials are available in http://www.cic.gc.ca/english/information/applications/skilled.asp,.
from you posting in sajha I understand that you have good knowledge of english. So go through that web page, download all forms for free, fill it and apply. All you have to pay is application fee. How much you have to pay is also available in that web site.
For your information at present for federal skilled worker class of immigration you have to pay 550 canadian dollars for principle applicant and 550 from each family memebr above 22 and 250 for each family memebr below 22
then later on you have to pay some money for permanent Visa . The embassy will let you know at that time how much you do have to pay

So, If you have access to the internet and you know english you can do all by yourself.You dont need anyone to represent yoy in Canada.Your application is precessed in canadian embassy new Delhi. and even their they dont listen to your lawyer.

For your present case,
1. If you application is already submitted to the embassy in New Delhi, you must have reference number, when application is submitted within a month or so the embassy acknowledges the application and gives applicant a reference number.
If this karki has submitted your application few months back he must have received the acknowledgment and reference. He may have given to you. Using that reference number you can check the status of your application in internet.

2. Try to find out wheather or not he has sent the application to the embassy. if not you can start a new application, if already applied try to get reference number which is very important.If he had already applied, he must have received a letter from embassy, he must have given a photocopy of it to you, check that letter and find the refrence number.

3. Now you need to change address of correspondence for future because all letters concerning you will go to the address of the Karki. If the address for further correspondence is your address then you dont need to worry about it. How to change the address? you can send a general email to the Canadian embassy in new Delhi, they might respond to it. usually they are slow to this type of situation.

4. If you have enough money go to another imigration lawyer pay money and he will take care of it.

I would like to repeate once again if you are not applying as  a refugee, human right abuse, are maoist or similar abuses, there is no use of immigration lawyer they just suck your money. These lawyers cant do anything more than filling the form and sending it to canadian embassy in new Delhi. Application are not sent to Canada.

I just came to know that a friend of mine and his friend also applied for Canada Immigration from Everest Immigration. They are aware about Mr. Milan Karki’s legal battle and potential consequences. They are really concerned.
 
I think, they key will be what the court verdict will be or what will happen to Mr. Karki’s licence. May be Nepali Diaspora know better about it. Or Nepali embassy in Canada should have information about it.

Arati Ji,

I have not heard about Embassy of Nepal in Canada. Do they exist?  I think all the diplomatic works for Canada are taken care of by Nepali embassy in US. I know there is a Nepali consulate in Toronto but never heard of Nepali Embassy in Canada.

I checked for some lawers in canda and found following. looks like they have site office in ktm too. I am not realted to them and I am not them. any contact of yours with them is soley your responsibility. If it turned out to be good  its you and if it turn out to be bad its you only. Not my responsibility. I personally dont know them. Be carefull when paying to anyone. Its your money

I just received the information from the lawyer himself.He said he is not related to the ktm office so if you want to contact the lawyer please contact him in atulsubedi@gmail.com

once again, the lawyer is not related to me

If you can read and write in English and have common sense and a bit of spare time,  I don't know why you need these agents. Most of them are not even lawyers. Just spend some time researching in www.cic.gc.ca and you would be a guru in no time...
